SUMMONS
THE STATE OF MINNESOTA TO THE ABOVE-NAMED
DEFENDANTS.
You are hereby summoned and required to answer the Complaint of the Plaintiff in the above-entitled action, a copy of which is on file in the office of the Court Administrator of the above-named Court, within twenty (20) days after service of this Summons upon you, exclusive of the date of service. If you fail to do so, judgment by default will be taken against you for the relief demanded in the Complaint.
This action involves, affects or brings into question real property situated in the County of Douglas, State of Minnesota, described as follows, to-wit:
That part of the West Half of the Southwest Quarter, Section 9, Township 128 North, Range 37 West, described as follows, to-wit: Commence at the Southwest corner of Section 9, Township 128 North, Range 37 West; thence East along the South line of said Section 9 to the West line of that lot designated as Subdivision A of Subdivision of part of the East Half of the Southwest Quarter and Lot 5 and all of Lot 6, of Section 9, Township 128 North, Range 37 West; thence North along the West line of that lot designated as Subdivision A of said Subdivision to the center line of Trunk Highway No. 29; thence South 64 degrees 11 minutes West along the center line of said T. H. 29 to the West line of Section 9, Township 128 North, Range 37 West; thence South along the West line of said Section 9 to the point of beginning.
EXCEPTING THEREFROM:
1. The following tract of land now known as Hi-View Trailer Park and described as follows: A part of the West Half of the Southwest Quarter of Section 9, to-wit: Begin at a point being North 00 degrees 00 minutes 37 seconds West 676.47 feet and North 89 degrees 59 minutes 23 seconds East 208.0 feet from the said Southwest corner of Section 9, thence North 00 degrees 00 minutes 37 seconds West 317.92 feet to a point being 66.0 feet from the right of way line of said Trunk Highway No. 29; thence North 64 degrees 11 minutes East and parallel with said right of way line 1035.95 feet; thence South 00 degrees 00 minutes 37 seconds East 768.86 feet; thence South 89 degrees 59 minutes 23 seconds West 792.6 feet; thence South 00 degrees 00 minutes 37 seconds East 200 feet; thence South 89 degrees 59 minutes 23 seconds West 140 feet; thence North 00 degrees 00 minutes 37 seconds West 200 feet more or less to the point of beginning.
2. Part of the Southwest Quarter of the Southwest Quarter, Section 9, Township 128 North, Range 37 West of the 5th P.M., being more particularly described as follows, to-wit: To find the point of beginning commence at the northerly most corner of Lot 5, SECOND ADDITION TO DIEKMAN’S HIGHWAY ACRES as duly filed and recorded in the office of the Register of Deeds, Douglas County, Minnesota; thence North 64 degrees 11 minutes East and along the southerly right-of-way line of the existing Service Road a distance of 66.0 feet to the point of beginning; thence from the point of beginning South 25 degrees 49 minutes East and along the easterly right-of-way line of the existing public road a distance of 160.00 feet; thence North 64 degrees 11 minutes East and parallel to the southerly right-of-way line of said service road a distance of 125.00 feet; thence North 25 degrees 49 minutes West and parallel to the easterly right-of-way line of said public road a distance of 160.0 feet to the intersection with the southerly right-of-way line of said service road; thence South 64 degrees 11 minutes West and along said right-of-way a distance of 125.00 feet to the point of beginning and containing 0.46 acre.
3. Plat of SECOND ADDITION TO DIEKMAN’S HIGHWAY ACRES
The object of this action is to obtain judgment declaring that the Plaintiff is the owner of the property, as its interests appear, and that the Defendants, and each of them, have no interest or estate in and to the property, nor lien thereon.
Notice is further given that no personal claim is made by Plaintiff against any of the Defendants.
