ORDINANCE NO. 853
AN ORDINANCE VACATING A PORTION OF THE PUBLIC STREET KNOWN AS FIFTH
AVENUE LOCATED WITHIN THE PLAT OF "HOLES' ADDITION
WHEREAS, the City has received an application from property owners adjacent to a portion of the platted street known as Fifth Avenue in the below-referenced portion of "Holes' Addition To Alexandria" to vacate said portion, and
WHEREAS, following a public hearing on said application the City finds that there is either no public use for the referenced portion of said public street or that any existing or proposed public use can be accommodated by other means,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ALEXANDIA HEREBY ORDAINS:
Section I: That the portion of the public street known as Fifth Avenue, located between Lot 7, Block 10 and Lot 1, Block 23 of "Holes' Addition to Alexandria" is hereby vacated.
Section II: That the City reserves the right of easement for utility purposes over the entirety of the portion of the street to be so vacated.
Section III: That a record of such vacation and utility easement is to be made in the office of the Douglas County Recorder
Section IV: This ordinance shall be in full force and effect from and after its passage and publication.
ADOPTED by the City Council of the City of Alexandria, Minnesota, this 10th day of May, 2021, by the following vote:
