Man accused of plotting Fargo dentist murder is on his way to Cass County Jail

OKLAHOMA CITY, Okla. - The 63-year-old man charged with conspiracy to commit murder in connection with the Oct. 26 fatal hammer beating of Fargo dentist Philip Gattuso was released from the custody of an Oklahoma County jail this morning and is expected to be in the Cass County Jail by Friday.

Gene Carl Kirkpatrick of Jones, Okla., whose daughter Valerie was married to Gattuso until her death in March, waived his right to challenge his extradition back to North Dakota in a hearing on Friday in his home state.

He was released at 5:37 a.m. today from the Oklahoma County Detention Center, where he had been held without bond since his arrest Nov. 2, according to a jailer.

Authorities have accused Kirkpatrick of hiring his former handyman, Michael Allen Nakvinda, to kill the single father of his granddaughter. Nakvinda faces a murder charge and has already been transported from Oklahoma to Fargo.

The Cass County Sheriff's Office said earlier this week that Kirkpatrick should arrive here by Friday.
