OCTOBER 23, 2012

The Board of Commissioners in and for the County of Douglas, State of Minnesota, met in Regular Session this 23rd, day of October, 2012. Following is a summary of actions taken at that meeting. The full text is available for public inspection in the County Auditor/Treasurer’s office.

To approve the agenda with one addition. Motion carried.

To approve minutes of the October 9th, 2012 Regular Board meeting as submitted. Motion carried.

To certify the Habitat Easement from Zach T. Pate and Bette B. Pate as presented by Cheri Sloneker, U.S. Fish and Wildlife Service. Motion carried.

To accept the recommendation of the Planning Commission and approve the conditional use permit for Brian Drown Etal/Jon Roschlein parcel number 51-0415-020 to allow a five unit planned unit development for seasonal recreational vehicle use with conditions. Motion carried.

To deny the application for Barbara Trisco parcel number 51-0285-000 to allow a 39.3 kw wind tower, based on findings identified by the Planning Advisory Commission and those discussed by the Commissioners. Motion carried.

To accept grant money from the Department of Human Services (Lexus Nexus system) as presented by Mike Woods. Motion carried.

To approve the request from Nevin Smith to use the Courthouse lawn and steps on November 4th for a “Walk for Life”. Motion carried.

To approve the request from First Lutheran Church to use the south Courthouse parking lot on Sundays. Motion carried.

To approve the modification to the Teamsters Supervisor contract as it pertains to maximum vacation accumulation for 2012 and 2013. Motion carried.

To approve the “No Expectation of Privacy” policy as presented by Bill Schalow. Motion carried.

By consensus the December 25th Regular Board meeting was cancelled.

By consensus the Board will meet with elected officials to set their 2013 salaries after the Regular Meeting on Tuesday, December 11th.

By consensus the Board will conduct annual department head reviews at 9:00 a.m. on Thursday, November 29th.

To adopt Resolution 12-57 approving equipment rental rates effective November 1st, 2012. Motion carried.

To adopt Resolution 12-58 regarding uncollectible bills. Motion carried.

To approve the Chippewa River Watershed agreement as amended. Motion carried.

To adopt Resolution 12-59 revoking County State Aid Highway 44. Motion carried.

To adopt Resolution 12-60 establishing County State Aid Highway 46. Motion carried.

RESOLUTION 12-67

RESOLUTION REVOKING

COUNTY ROAD 106

WHEREAS, it appears to the County Board of the County of Douglas that the road hereinafter described as a County Road under the provisions of Minnesota Law.

NOW THEREFORE, BE IT RESOLVED, by the County Board of the County of Douglas that the road described as follows, to-wit:

Beginning at a point approximately 270 feet east of the southwest corner of Section 32, Township 128 North, Range 37 West at the west right-of-way of the Soo Line (CP Rail) Railroad; thence easterly along the south line of said Section 32 (50th Ave) to the South Quarter Corner of said Section 32; thence northerly along the North-South Quarter Line of said Section 32 (Pioneer Rd) to its intersection with County State Aid Highway 46 at the North Quarter Corner of Section 32, T128N, R37W, and there terminating.

Approximate Length: 1.45 miles

be, and hereby is, revoked as a County Road of said County and shall revert to the City of Alexandria.

At 10:50 a.m. Commissioner Olson left the meeting.

Dave Robley made a power point presentation to the Board on his FHWA trip to Russia.

A motion was made by Anderson, seconded by Salto to adopt the following resolution providing for the sale of G.O. Capital improvement Plan Bonds:

RESOLUTION 12-68

Resolution Providing for the Sale of $7,465,000 G. O. Capital Improvement Plan Bonds

A. WHEREAS, the Board of County Commissioners of Douglas County, Minnesota, has heretofore determined that it is necessary and expedient to issue the County’s $7,465,000 G.O. Capital Improvement Plan Bonds, to effect a net cash advance refunding of the Public Project Lease Revenue Bonds, Series 2008A, of the Douglas County HRA; and

B. WHEREAS, the County has retained Ehlers & Associates, Inc., in Roseville, Minnesota (“Ehlers”), as its independent financial advisor for the $7,465,000 G.O. Capital improvement Plan Bonds and is therefore authorized to solicit proposals in accordance with Minnesota Statutes, Section 475.60, Subdivision 2(9);

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Douglas County, Minnesota, as follows:

1. Authorization; Findings. The Board of County Commissioners hereby authorizes Ehlers to solicit proposals for the sale of the $7,465,000 G.O. Capital Improvement Plan Bonds;

2. Meeting; Proposal Opening. The Board of County Commissioners shall meet at 1:00 p.m. on Tuesday, November 27th, for the purpose of considering sealed proposals for and awarding the sale of the $7,465,000 G. O. Capital Improvement Plan Bonds;

3. Official Statement. In connection with said sale, the officers and employees of the County are hereby authorized to cooperate with Ehlers and participate in the preparation of an official statement for the Capital Improvement Plan Bonds and to execute and deliver it on behalf of the County upon its completion.

Commissioner Salto updated the Board on the Juvenile Detention Center meeting.

Commissioner Bales reported on the Mental Health Consortium.

A motion was made by Bales, seconded by Anderson to adjourn the meeting at 11:30 a.m. Vote: Yes - Anderson, Bales, Johnson and Salto. Motion carried.
