OSAKIS TOWNSHIP

SPECIAL MEETING NOTICE

Pursuant to Minnesota Statute § 365.52, a special town meeting may be held to conduct any lawful business. Prior to calling a special meeting, the supervisors and town clerk, or any two of them together with at least 12 other town landowners, shall file a statement in the town clerk’s office. The statement must tell why the meeting is called, the particular business to be transacted, and that the interests of the town require the meeting.

Minnesota Statute § 164.06 provides that, “[a] town board, when authorized by a vote of the electors at the annual meeting, or at a special meeting called for that purpose, may establish, alter, or vacate a town road…”

The purpose of this statement is to conform to the requirements of Minnesota Statute § 365.52 to call a special meeting for the purpose of considering the vacation of the following described alleged road:

LEGAL OF ROAD TO BE VACATED: commencing at the center of Section 18, Township 128 North, Range 36 West, and continued North approximately one-half (1/2) mile along the half section line to the North line of Section 18 and there terminating.

The above described road was the subject of litigation between Gerard Anthony Gay, Plaintiff and Dee Ann H. Conover Fetterer and Osakis Township, Defendants, Douglas County Court File Number 21-CV-07-1075.

The parties to the lawsuit participated in Mediation on March 27, 2008. The mediation resulted in a settlement agreement. Part of the mediated settlement agreement was, “Contingent upon Town Board vacating all of road except southerly 660’.4.”

To date, the Town Board has not vacated the subject road. Osakis Township has been approached by Dee Ann H. Conover Fetterer requesting that Osakis Township vacate the subject road. It is in the interests of the town to require a meeting for the purposes of considering the vacation of the subject road and to comply with the mediated settlement agreement.

A special meeting shall therefore be called for the purpose of considering vacating the subject road. The only business that shall occur at the special meeting shall be the consideration and possible vacation of the subject road.

The special meeting will be Monday, September 12, 2011 7 PM at the clerk’s home at 17374 S Ketelle DR NE, Osakis, MN, for the purpose of considering vacation. The regular monthly meeting will follow.
