Scott Stewart, Sandra A. Stewart f/k/a Sandra A Korkowski, the unknown Heirs of Joseph Korkowski, and any unknown person claiming any right, title or interest in the real estate described in the Complaint herein.
THE STATE OF MINNESOTA TO THE ABOVE-NAMED DEFENDANTS:
You are hereby summoned and required to serve upon Plaintiff’s attorney an Answer to the Complaint herein which has been filed with the Clerk of the above-named Court at the Courthouse in the City of Alexandria, County of Douglas, State of Minnesota, within twenty (20) days after the service of this Summons upon you, exclusive of the day of such service. If you fail to do so, judgment by default will be taken against you for the relief demanded in the Complaint.
You are further notified that this action involves the title to the following described real estate situated in the County of Douglas, State of Minnesota, to-wit:
Those portions of Lots R and S, Miller Badens, et al., Subdivision, according to the recorded plat thereof, lying westerly of a line described as follows:
Beginning at a point on the North line of said Lot R, distant 826.74 feet East, plat bearing from the Northwest corner of the Southwest Quarter of the Southwest Quarter of Section 14, Township 130 North, Range 39 West of the fifth principal meridian, Douglas County, Minnesota: thence South 1º 43’ 06” West about 141 feet to the South line of said Lot S and said line there terminating.
The object of this action is to secure a Judgment that Defendants Scott Stewart, Sandra A. Stewart f/k/a Sandra A Korkowski the owners of said property in fee simple, subject to a mortgage in favor of Plaintiff and that the Defendants the unknown Heirs of Joseph Korkowski, and any unknown person claiming any right, title or interest in the real estate described in the Complaint herein have no right, title, estate or interest therein or lien thereon. Furthermore, the object of this action is to secure a Judgment to reform certain deeds, a mortgage, and Summary Real Estate Disposition Judgment to correct the incorrect legal description contained in said documents. You are hereby notified that no personal claim is made against any of the Defendants listed herein.
Parties are required to attempt alternative dispute resolution under Minnesota law. Alternative dispute resolution includes mediation, arbitration, and other processes as set forth in the district court rules. You may contact the court administrator about resources in your area.
