ORDINANCE NO. 652
2ND SERIES
AN ORDINANCE VACATING
A PORTION OF A
DEDICATED BUT UNBUILT,
UN-NAMED STREET
LOCATED EAST OF
NORTH NOKOMIS STREET
WHEREAS, the City has received a request to vacate a portion of an unbuilt public street, and
WHEREAS, the City has no current or future need for said portion of the street, and
WHEREAS, the City’s Home Rule Charter requires that such vacations be done by Ordinance, approved by a four-fifths vote of the Council,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ALEXANDRIA HEREBY ORDAINS:
SECTION I: That the portion of the street to be vacated is described as following:
East 200’ of the North 20’ of the West 350’ of Lot A, Auditor’s Subdivision of W 1/2 of NW 1/4 Section 17, Township 128 North, Range 37 West, Douglas County, Minnesota
SECTION II: That a permanent utility easement is hereby established over and under the lands described in Sectioin I of this ordinance.
SECTION III: That a record of such vacation and easement is to be made in the office of the County Recorder.
SECTION IV: This ordinance shall be in full force and effect from and after its passage and publication.
ADOPTED by the City Council of the City of Alexandria, Minnesota, this 28th day of December, 2009, by the following vote:
YES: BIGGER, CARLSON, MILLER, BENSON, FRANK
NO: NONE
ABSENT: NONE
