Notice is hereby given, that under and by virtue of the Findings of Fact, Conclusions of Law, and Order for Judgment herein executed October 13, 2009, and the Judgment thereon entered in the above entitled action on October 15, 2009, a certified copy of which has been delivered to me, directing the sale of the premises hereinafter described to satisfy the amount found and adjudged due plaintiff M&I Marshall & Ilsley Bank in the above entitled action as prescribed in the Findings of Fact, Conclusions of Law, and Order for Judgment, and the Judgment thereon, the undersigned Sheriff of Douglas County, Minnesota, will sell at public auction, to the highest bidder, for cash, on the 14th day of January, 2010, at 10:00 A.M., at the Sheriff’s main office, 216 Seventh Avenue West, Alexandria, Minnesota, within the said County and State, the premises and real estate legally described in said Findings of Fact, Conclusions of Law, and Order for Judgment, and the Judgment thereon, lying and being in the County of Douglas, State of Minnesota, and legally described as follows, to-wit:

That part of the NW1/4 of the SE1/4 of Section 28, Township 127 North, Range 40 West, Douglas County, Minnesota, described as follows:

Commencing at the southeast corner of said NW1/4 of the SE1/4; thence South 00°16’03” East, County Coordinate Datum NAD 83, along the east line of the W1/2 of said SE1/4 84.14 feet; thence North 88°18’39” West 2.03 feet to an iron monument marking the northeast corner of the Minnesota Conservation Department Wild Life Management Area; thence continuing North 88°18’39” West along the North line of said Wildlife Management Area 842.76 feet to an iron monument; thence North 12°36’32” West along the easterly line of said Wildlife Management Area 488.03 feet to an iron monument and the point of beginning; thence reversing South 12°36’32” East 111.36 feet; thence South 88°18’39” East 355.66 feet; thence North 40°17’00” East 131.02 feet; thence North 10°36’14” East 581.78 feet to the intersection with the southerly right-of-way line of the Soo Line Railroad and the Trunk Highway No. 55; thence North 61°30’54” West along said right-of-way to the intersection with the east line of a tract as described in Document No. 163939 on file in the Office of the County Recorder Douglas County, Minnesota; thence southerly along said easterly line to the southeast corner of said tract, which bears North 03°42’50” East from the point of beginning; thence South 03°42’50” West 724.37 feet, more or less, to the point of beginning (containing 9.21 acres, more or less),

together with all improvements thereon, and all appurtenances and hereditaments thereto (the “Real Property”).
