ORDER OF THE
ALEXANDRIA CITY COUNCIL
TO: GALBRAITH INVESTMENTS, LLC, PO BOX 458, ALEXANDRIA, MN 56308.
Pursuant to Minnesota Statutes Sections 463.16 et. seq., the City Council of the City of Alexandria, Minnesota hereby ORDERS:
I. That the structure located at 403 3rd Avenue East (Parcel No. 63-1228-050) in the City of Alexandria, Minnesota, owned by Galbraith Investments, LLC (hereinafter referred to as "the Property") be razed and removed.
II. That the grounds for ordering the Property to be razed and removed are that on or about August 2, 2013 the Property was burned out during a fire, and as a result, the Property is abandoned and is in the following condition: not weathertight; unprotected openings in the rear wall; part of the roof covering is no longer intact and/or weathertight; interior of the Property has severe fire, smoke and water damage throughout; electrical, mechanical and plumbing systems are wet, rusty, and burnt; Property is not kept secured; the Property is in a high traffic area near a school for elementary and middle school-aged children thereby creating an attractive nuisance and endangering children and the general public.
III. That the above-cited conditions constitute a hazardous building and property conditions in that the Property is inadequately maintained, is dilapidated, has physical damage, is unsanitary, is a fire hazard, and is a hazard to public safety and health.
IV. In lieu of razing and removing the Property, the hazardous condition existing on the Property may be remedied by contacting the Building Inspector for the City of Alexandria and securing the necessary building permits if applicable and completing the following repairs: repair of items listed in paragraph II above.
V. That the owner of the Property shall comply with this Order within 20 days of the date of service of this Order, said time being a reasonable amount of time in which to comply.
A MOTION FOR SUMMARY ENFORCEMENT OF THIS ORDER WILL BE MADE TO THE DISTRICT COURT OF DOUGLAS COUNTY UNLESS CORRECTIVE ACTION IS TAKEN, OR UNLESS AN ANSWER IS SERVED IN THE MANNER SPECIFIED IN THE MINNESOTA RULES OF CIVIL PROCEDURE UPON THOMAS A. JACOBSON, CITY ATTORNEY, 710 BROADWAY, PO BOX 787, ALEXANDRIA, MN 56308, WITHIN TWENTY (20) DAYS FROM THE DATE OF SERVICE OF THIS ORDER.
