Next phase of Osakis murder case starts in December

The man charged with the murder of Osakis resident Diane Fortenberry will be back in court in December.

On June 24, Todd County District Court set an omnibus hearing for December 5 at 1:30 p.m. for Jeffery Allen Brooks. Last month, Brooks waived his right to a speedy omnibus hearing.

Brooks is charged with second-degree murder for the death of Fortenberry on May 20.

Fortenberry had reportedly returned home during the lunch hour and walked in on a burglary.

Her death was ruled a homicide due to the blunt force head trauma she suffered, according to court records.

Investigators found several items stolen from the Fortenberry home in a dumpster in Alexandria, including a pair of bloodied shoes in a plastic shopping bag. Blood on the shoes matched Fortenberry's DNA and a thumbprint on the shopping bag was linked to Brooks, according to law enforcement.

Brooks' fingerprints were in the state's system after several felony burglary convictions in Stearns County in 2005 and theft in Otter Tail County in 1998.
