FORECLOSURE SALE

THE RIGHT TO VERIFICATION OF THE DEBT AND IDENTIFICATION OF THE ORIGINAL CREDITOR WITHIN THE TIME PROVIDED BY LAW IS NOT AFFECTED BY THIS ACTION.

NOTICE IS HEREBY GIVEN: That default has occurred in the conditions of the mortgage dated February 23, 2004, executed by Edwon O. Enga, Jerald L. Enga and Jeffrey E. Enga all single persons, as mortgagors, to M&I Bank FSB as mortgagee, recorded in the office of the County Recorder of Douglas County, on March 16, 2004, as Document No. 253935, which mortgage conveyed and mortgaged the following described property, situated in the County of Douglas and State of Minnesota:

Lot 23, Block 1, Red Rock Shores, Douglas County, Minnesota, according to the plat and survey thereof on file and of record in the Office of the Register of Deeds in and for Douglas County, Minnesota.

Together with an easement for Sanitary Sewer Disposal System purposes over, under and across that part of Government Lot 2, Section 29, Township 128 North, Range 40 West, Douglas County, Minnesota, described as follow: Commencing at the Westerly most corner of Lot 23, Block 1, RED ROCK SHORES, according to the recorded plat thereof; thence North 26 degrees 28 minutes 00 seconds West, record bearing, along the Northwesterly extension of the Southwesterly most line of said Lot 23, a distance of 66.15 feet to the Northwesterly most line of a public road, said point being the point of beginning of the land to be described; thence continuing North 26 degrees 28 minutes 00 seconds West 100.00 feet, thence North 59 degrees 43 minutes 00 seconds East 100.00, thence South 26 degrees 28 minutes 00 seconds East 100.00 feet to the afore said Northwesterly most line of a public road, thence South 59 degrees 43 minutes 00 seconds West, along said Northwesterly most line, 100.00 feet to the point of beginning.

That Harris National Association was successor by merger to M&I Bank FSB, and is now known as BMO Harris Bank N.A.

To the best of the knowledge of the party foreclosing the mortgage, the common address of the property is 23178 Red Rock Shores Dr. SW, Hoffman, MN 56339 and the property identification number is 60-0290-000. The name of the lender is BMO Harris Bank N.A. If the mortgage is not reinstated under section 580.30 or the property redeemed under section 580.23, the time to vacate the property is 11:59 P.M. on December 20, 2014.

That the original principal amount secured by said mortgage was $ 45,000.00; that there has been compliance with any condition precedent to acceleration of the debt secured by said mortgage and foreclosure of said mortgage required by said mortgage, any note secured thereby, or any regulation or statute; that no action or proceeding has been instituted at law to recover the debt remaining secured by said mortgage, or any part thereof; that there is claimed to be due upon said mortgage and is due thereon at the date of this notice, the sum of $ 42,322.22.

That by virtue of the power of sale contained in said mortgage, the said mortgage will be foreclosed by the sale of the above described premises with the hereditaments and appurtenances, which said sale will be made by the Sheriff of Douglas County, Minnesota, in lobby of the Douglas County Sheriffs Department, 216 7th Ave. W. in the City of Alexandria in said County on June 20, 2014, at 10:00 AM, at public auction to the highest bidder, to pay the amount then due on accordance with the provisions of said mortgage. The time allowed by law for redemption by the mortgagors or the personal representatives or assigns of the mortgagors is 6 months from the date of said sale.

THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE MORTGAGOR, THE MORTGAGORS PERSONAL REPRESENTATIVES OR ASSIGNS, MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.
