NOTICE OF AMENDMENT TO

THE DOUGLAS COUNTY

ZONING ORDINANCE AS IT

RELATES TO STORM WATER

MANAGEMENT WITHIN THE SHORELAND ZONING DISTRICT.

Please take notice that on the 18th day of September, 2018 at 9:05 a.m., the Douglas County Board of Commissioners adopted an amendment to the Zoning Ordinance that places a temporary restriction on permitting of credit for pervious pavement systems for a period of one year or until such earlier time as Douglas County determines by resolution that the reasons for the interim ordinance no longer exist. The interim zoning amendment was adopted as follows:

Section 1. Temporary Restrictions on permitting of credit for pervious pavement systems. For a period of one year from the effective date of this Interim Ordinance, or until such earlier time as the Douglas County Board of Commissioners determines by resolution that the reasons for the interim ordinance no longer exist. No application (pending or future) for any part of a pervious pavement system to be considered pervious shall be accepted, processed or approved by the County.

Section 2. Definitions and Application. The term "pervious pavement system" shall mean any pavement system designed to allow the infiltration of water between pavers.

Section 3. Effective Date. This Ordinance shall take effect on the date of its passage and shall be in effect for a period of one year from the date hereof, unless earlier terminated by the Douglas County Board of Commissioners.

Section 4. Severability. Every section, provision, or part of this Interim Ordinance is declared severable from every other section, provision, or part thereof to the extent that if any section, provision, or part of this ordinance shall be held invalid by a court of competent jurisdiction, it shall not invalidate any other section, provision, or part thereof.
